Terms of Service

This is an English translation provided for convenience. In case of any discrepancy, the Japanese version prevails.

These Terms set out the conditions for using the API service “noisymoon API” (the “Service”) provided by NOISYMOON (operated by 田中 伸明; the “Operator”).

Article 1 (Application)

Anyone who uses the Service (a “User”) shall use the Service after agreeing to these Terms.

Article 2 (Accounts and API Keys)

  1. Users create an account using an email address.
  2. Users are responsible for managing their API keys and must promptly revoke a key if it becomes known to a third party. Any usage fees arising from the leakage of a key shall be borne by the User.

Article 3 (Fees and Credits)

  1. Usage fees for the Service are deducted, each time the Service is used, from credits purchased in advance. Fees are shown on the API documentation page.
  2. Credits are valid for 180 days from the date of purchase. Credits that have passed their expiry date lapse, and no refund will be given.
  3. Credits cannot be exchanged for cash or transferred to a third party.
  4. If the Service cannot be provided for reasons attributable to the Operator, the affected usage will be compensated with credits.

Article 4 (Prohibited Conduct)

Users must not engage in any of the following:

  1. Conduct that interferes with the operation of the Service (including placing excessive load on it or probing it for vulnerabilities)
  2. Using another person’s API key or account
  3. Conduct that violates laws and regulations or public order and morals

Article 5 (Computation Results)

  1. The Operator endeavors to ensure the accuracy of computation results but does not guarantee their completeness or fitness for a particular purpose.
  2. Users shall use computation results at their own discretion and responsibility.

Article 6 (Changes to and Suspension of the Service)

The Operator may suspend or change all or part of the Service without prior notice for maintenance, due to failures, or for other unavoidable reasons.

Article 7 (Disclaimer)

The Operator is not liable for any damage incurred by a User through use of the Service, except where caused by the Operator’s willful misconduct or gross negligence. Even where the Operator is liable, the amount is limited to the usage fees paid by the User in the month in which the damage occurred.

Article 8 (Changes to These Terms)

The Operator may change these Terms as necessary. The revised Terms take effect when they are posted on this page.

Article 10 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan, and the Tokyo District Court shall have exclusive agreed jurisdiction as the court of first instance for any dispute relating to the Service.
